The advent of the Licensed Building Practitioner scheme has many building practitioners questioning themselves what additional liabilities the new scheme now imposes on them. Litigation brought about by the leaky building syndrome has publically presented the risks and obligations of those involved with design and build.
This has been a difficult pill for the residential industry to swallow, however it has highlighted the risky environment many practitioners were unaware they were, and still are, working within.

Certified Builders is currently undertaking a series of regional presentations to enlighten building practitioners how accountability and liability is bestowed upon them. The duty of care to a homeowner underlines product and services the residential sector must deliver through doing it right first time. On Tuesday night at the Tauranga Yacht and Power Boat Club we look at case law and how liability is indentified, quantified and how costs are awarded. We then take this scenario and dump it into the licensing scheme and see what, if anything has changed.
Managing risk
Once a building practitioner understands risk they can then manage and reduce it, through good business practices. Certified Builders will analyse several simple steps that are practical to on-site operations. Using technology on a mobile phone we have an efficient on-site management tool, couple this with smart phone technology and tradesmen now have a very efficient and secure capture/store business tool.
The association is very concerned with the cost of legal defence; the scatter gun approach of getting parties around the table for a robust discussion might be good news for the legal teams involved, however the associated cost of this can be massive. With this in mind Certified Builders has brought on board CBA Insurances to line up risk protection cover, tailored for the building industry.
